4. How to File a DMCA Takedown Notice
If you are a copyright owner (or an authorized agent) and believe that any content on our Site infringes upon your copyright, you may submit a written takedown notice. Your notice must include the following information:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works are covered by a single notification, you may provide a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled. Please include information reasonably sufficient to permit us to locate the material (e.g., the specific URL(s) of the page(s) where the material is located).
- A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Your contact information, including your full name, mailing address, telephone number, and email address.
Failure to include all of the above information may result in a delay in processing your request or a determination that the notice is invalid.
5. Counter-Notification Process
If you believe that your content was removed or access was disabled as a result of a mistake or misidentification, you may file a counter-notification with our Designated Copyright Agent. Pursuant to 17 U.S.C. §512(g), your counter-notification must be a written communication that includes the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location (URL) at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside of the United States, for any judicial district in which CasinoBigNews.com may be found), and that you will accept service of process from the person who provided the original infringement notification or an agent of such person.
Upon receipt of a valid counter-notification, we will forward it to the complaining party. The removed material may be restored within 10 to 14 business days unless the copyright owner notifies us that they have filed a legal action seeking a court order to restrain the allegedly infringing activity.
6. Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances, users or contributors who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
7. Our Removal Process
Upon receipt of a valid takedown notice, we will act expeditiously to remove or disable access to the allegedly infringing material. We will also take reasonable steps to notify the user or contributor who posted the content. We reserve the right to preserve any and all records related to DMCA notices and counter-notifications.
8. Third-Party Content
CasinoBigNews.com may link to or embed content that is hosted on third-party websites or delivered through Content Delivery Networks (CDNs). We do not have control over the content hosted by these third parties. If you believe your copyrighted material is hosted by a third party and is being displayed on our Site, we recommend you contact the third-party hosting provider directly to have the content removed at the source.
9. Warning Against Misrepresentation
Under 17 U.S.C. §512(f), any person who knowingly materially misrepresents that material is infringing or that material was removed by mistake or misidentification may be subject to liability for damages, including costs and attorneys’ fees. Abusing the DMCA process is a serious matter, and we will pursue legal action against fraudulent claims.
